Columbia, South Carolina: Domestic Abuse Defense

If you have been charged with criminal domestic violence, you need to contact an experienced criminal defense attorney immediately. A conviction - even for a first offense - can carry very serious penalties, including up to a $2,500 fine or a 30-day jail sentence. If this would be your second or third conviction, the penalties can be even more serious - if you are convicted for a third offense of criminal domestic violence, for example, South Carolina's sentencing guidelines require a one-year prison sentence.

At the Law Office of David B. Tarr, LLC, we defend all levels of criminal domestic violence charges, from first offenses to charges of high and aggravated criminal domestic violence (HAN CDV). My entire 12-year legal career has been devoted to protecting the rights of South Carolinians charged with crimes, and I have the negotiation skills and jury trial experience that can sometimes make the difference between a successful result and a prison sentence.

South Carolina's laws treat domestic assault very seriously. Police are required to make an arrest if they respond to a domestic battery call and observe an injury and also reasonably believe that you have either caused the injury or violated a standing restraining order.

Even if the complaining witness drops the complaint against you, the prosecutor's office may still pursue a conviction. However, they must be able to prove their case, which is where my services as an experienced criminal defense attorney come into play.

As your defense lawyer, I will carefully examine all the evidence against you, including any witness statements. If possible, I will negotiate with the prosecutor's office to:

  • Get the charges dropped
  • Plea bargain for a guilty plea to a lesser offense that carries lower penalties
  • Argue for you to receive a suspended sentence, which may be removed from your criminal record if you stay out of trouble with the law for a certain period of time and successfully complete a program for domestic violence offenders
