Administrative Hearings Are Not the Same As Criminal Court Hearings

Most often, individuals who are charged with DUI/DWI do not understand that they must participate in two separate systems. While most people are familiar with the criminal charges and court hearings that come along with a drunk driving charge, they do not understand that the state also takes an interest in suspending driving privileges through a separate administrative hearing process held by the Department of Motor Vehicles (DMV).

DUIs and Automatic Driver's License Suspension

In certain situations, the state may enforce an automatic driver's license suspension against you. This most often occurs:

  • If you refuse a breath test or any other test you are asked to give
  • If you take a test and you blow .15 or higher

In the first instance, you will automatically lose your driving privileges for six months. In the second, your license is suspended for 30 days.

However, it is still possible for you to obtain an administrative driver's license that provides for restricted driving privileges. You need someone with the knowledge and skill to request a hearing and fight for you. It is important to understand that, while you may be eligible for a restricted license, you will be required to install an ignition interlock device at your own expense and pay maintenance fees.
